It is an unfortunate fact in life that not all marriages are successful. When a relationship breaks down it is not unusual for one or both parties to seek to obtain a divorce. Both parties can either agree the division of the matrimonial assets or go to Court to enable a Sheriff to decide who gets what.
There are also disputes with regard to children under the age of 16 and a decision has to be made as to where they reside and whether they have contact with their non – resident parent.
The ownership of the assets of the family must be decided. Everyone’s circumstances differ slightly and many factors have to be considered in deciding how these matters are determined. It is often the case that matters can be resolved by means of a formal written Separation Agreement.
